Hearing Settlement Case Study:
Toxic Tort/Pay Federal Collective Bargaining Litigation
GLSGI professionals provided support to the federal government in defending a claim for entitlement to additional pay due to exposure to a toxic substance (asbestos). This claim was brought on behalf of a class of more than 4,000 civilian employees alleging exposure from numerous sources and work processes over a 20-year period. Defendant's theoretical worst-case liability exceeded $300,000,000. GLSGI professionals provided comprehensive support to this defense effort, including Matter Resolution in support of a three-week hearing:
Comprehensive Support:
- established and staffed on-site litigation support office; designed, procured and installed necessary technological infrastructure
- worked with defense attorneys to define scope and character of support effort and appropriate strategies for case defense, including expert support needs
- identified, collected and reviewed millions of pages of documents and numerous large electronic data sets
- conducted more then 250 investigative interviews of witnesses and document custodians
- developed document, data and information management systems and databases enabling staff to:
- identify key documents and incomplete documents
- respond quickly and accurately to numerous discovery requests
- locate the documents identified in the more than 1,100 Plaintiff exhibits (nearly 100,000 pages)
- identify and electronically link documents for use in defense exhibits/rebuttal exhibits
- prepare multiple copies of more than 5,600 defense exhibits totaling more than 290,000 pages
- identified, contacted, and engaged expert witnesses in medical and other fields; managed expert effort
Matter Resolution:
- identified, secured and prepared a suitable space for three-week hearing on procedural and merits issues
- coordinated production and distribution of plaintiff and defendant exhibits in both electronic and bound hard-copy format
- established and staffed a war room for use by the defendant during the hearing; established secure workspaces for plaintiff team and arbitrator
- designed and deployed a multiple-monitor system permitting video display of all electronic or hard copy exhibits
- designed and deployed simplified document management tool for in-trial defense use, allowing the attorneys to script exhibit sets for each witness, to modify and annotate scripts on the fly, and to quickly locate and display any exhibit during cross examination
- developed and produced numerous demonstrative exhibits using a variety of media
- coordinated schedules, travel and accommodations for witnesses and others involved in hearing
- coordinated and participated in planning meetings between attorneys, witnesses, and others involved in hearing
Outcome:
The defense of this matter was successful. The arbitrator dismissed plaintiffs' claims in part and limited the defendant's liability to ten percent of plaintiff's remaining claims. Both parties appealed the decision to the Federal Labor Relations Authority, which dismissed plaintiffs' claims in full.
