Case Study:

Class Action Employment Discrimination (Title VII) Litigation

GLSGI professionals provided support to the Federal government in a class action employment discrimination lawsuit alleging discrimination on the basis of race, sex and age in hiring, appraisal scores, promotions, retention and pay. The original claims included 50 separate actions directly involving named plaintiffs and numerous complex internal processes and policies, with a potential class of more than 11,000 plaintiffs.

GLSGI professionals worked with the attorneys to:

  • review the claims to determine initial defense strategy and develop a litigation management plan
  • identify and interview witnesses with knowledge of relevant policies or processes, involvement in specific actions at issue, specialized experience in relevant areas or who were potential document or data custodians
  • integrate widely geographically dispersed experts, vendors, attorneys and legal team members into cohesive team
  • outline the document and data population to be collected and the information to be captured from each type of document or data set
  • compile information from witness interviews to fully understand the processes involved and to create and implement a focused information collection and data capture plan, reducing the population of potentially relevant material to be collected from the equivalent of 10,000,000+ documents to less than 900,000
  • assist with the construction of analytical databases to be used by the testifying experts
  • modify case strategy and litigation management plan throughout a protracted and dynamic discovery process as additional evidence was uncovered through document review, data analyses, investigative interviews, depositions, and actions of opposing counsel
  • develop and update case management tools in areas such as: budget management and forecasting, task tracking and prioritization, tracking and communication of all case deadlines

This coordinated process allowed the litigation team to concentrate support efforts on the most relevant documents, data and witnesses in order to identify and analyze evidence as quickly as possible. Through the information collection and review efforts of the GLSGI team, case attorneys and experts had access to the data and documents necessary to evaluate the strengths and weaknesses of both the legal and scientific aspects of the case, and to develop an appropriate defense strategy. Due to their in-depth understanding and familiarity with the case issues, relevant process, facts of the specific actions at issue and the information collected, GLSGI professionals were able to provide direct assistance to the attorneys in drafting and/or responding to discovery requests, motions, court rulings and with vital deposition preparation.

As a result of these efforts the U.S. District Court denied class certification and all claims of the named plaintiffs were dismissed. The decisions were appealed to the Circuit Court of Appeals where the decisions were upheld.
